OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed by being struck by the excavator:     Location: 83 Moseley Avenue, Newburyport, MA:    On or about 4/23/13, employees were walking and working in close proximity to the Volvo, model ECR235 excavator and exposed to being struck, where there was no swing radius protection system being utilized.  On 4/23/13 an employees left foot and ankle were run over by the tracks of the Volvo, model ECR235 excavator was hospitalized and the employees left leg up to the knee was amputated.
