Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards:   (a)  On or about April 23, 2013, for the employees exposed to fire and explosion hazards from the off gassing of hydrocarbon vapors where a crude oil/water mixture in a fracking tank was approximately 56 feet from the ignition sources of a diesel generator at the Delvin Dukart 1-31-30H well site, Manning, ND.    Abatement Note:  Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that:  "Discharges of oil or gas to the atmosphere should be to a safe area, preferably on the downwind side of the well and a minimum of 100 feet (30.5 m) from the wellhead, open flame, or other sources of ignition.", as described in Section 12 of the American Petroleum Institute - Recommended Practice 54, "Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations".

Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:   (a)  On or about April 23, 2013, for the employees exposed to struck-by hazards where the steel pipe running from the pumping truck to the well head was not secured to prevent movement should the line fail during an uncontrolled release of pressure from the well at the Delvin Dukart 1-31-30H well site, Manning, ND.   Abatement  Note:  Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that each section of a high pressure rigid line is secured using appropriate means to prevent movement should the line fail as described in Section 9 of the American Petroleum Institute - Recommended Practice 54, "Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations".
