29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions:     Construction Site, Camp Parks: As the controlling employer, San Jose Construction did not ensure its sub-contractor, Blackwell General Engineering, provided and required employees to wear seat belts while operating heavy equipment. On April 23, 2013, a sub-contracting employee was exposed to the hazard of becoming displaced from the seat of a Kobelco excavator and subsequently becoming crushed or ran over while operating earthmoving equipment without wearing the seat belt.

29 CFR 1926.251(a)(2)(i): Employers did not ensure that rigging equipment had permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load:    Construction Site, Camp Parks: As the controlling employer, San Jose Construction did not ensure its sub-contractor, Blackwell General Engineering, provided its employees with lifting chains containing pertinent information. On April 23, 2013, employees were exposed to crushing hazards while hoisting items such as, but not limited to, approximate 200 pound concrete manholes with a lifting chain that did not have a load rating tag indicating its purpose or capacity.
