29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. Job site located at 130 Hwy 75, Herman, NE 68029-Employees were allowed to use a forklift at the facility where there had been a modification to one of the forks. There had been a hole drilled in the tip of one of the forks without having prior written approval from the manufacturer of the forks. The employer stated that the hole in the tip of the fork has been there since he has been with the company. The employer also stated that the hole in the fork was used to pull material and equipment. Employee state that the hole in the forks of the list has been there for at least two years.

29 CFR 1910.215(a)(4): Work rests. On offhand grinding machines, work rests shall be used to support the work. They shall be of rigid construction and designed to be adjustable to compensate for wheel wear. Work rests shall be kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage. The work rest shall be securely clamped after each adjustment. The adjustment shall not be made with the wheel in motion. Job site located at 130 Hwy 75, Herman, NE 68029-The employer allowed employees to use a pedestal grinder in the maintenance area where the work rest was not adjusted within 1/8 inch of the wheel.

Booths and screens shall permit circulation of air at floor level. Workers or other persons adjacent to the welding areas shall be protected from the rays by noncombustible or flameproof screens or shields or shall be required to wear appropriate goggles.
