OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about April 29, 2013, an employee was exposed to a struck-by hazard, by a power industrial truck while the employee operated the Hyster Forklift, model H50XM, s/n: D177B02182P, without using the seatbelt while moving material from the storage yard to the shipping area.

29 CFR 1910.212(a)(1): Guards on machines were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, and rotating parts: On or about April 29, 2013, and at times prior thereto, employees were exposed to an amputation hazard from: (a) Shipping area, by the East wall: A Craftsman 14in Chop Saw (Model 2730, SN: 077700) which had no guard system for the rotating blade. (b) Tamping area on South-east side of facility; mixer closest to the main floor of the facility: A Stow Mortar and Plaster Mixer (Model M18, SN: 9617300) which had no guard system for rotating mixing pedals.

Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, were not being guarded in accordance with the standards specified in paragraphs (m) and (o) of this section. On or about April 29, 2013, and at times prior thereto, employees were exposed to an amputation hazard from: (a) Heavy gravel mixing area; mixer on the left: A heavy Gravel Mixer (make and model not found) which had an inadequate guard system for the rotating wheel. (b) Heavy gravel mixing area; mixer on the right: A heavy Gravel Mixer (make and model not found) which had an inadequate guard system for the rotating wheel. (c) Tamping area on South-east side of facility; mixer in the corner closest to the exit: A Plaster Mixer (make and model not found) which had an inadequate guard system for the rotating wheel. (d) Main tamping area; mixer on the right: A mixer (make and model not found) which had an inadequate guard system for the rotating wheel.
