29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Utility Truck (Ct Plate number 7056CR) - On or about May 25, 2013, the employer failed to maintain a safety program which provided for regular inspections of jobsites, materials and equipment to be made by a competent person. The utlity truck contained defective or ungaurded equipment, not safe for use, available for ready use and some of which was being used during the inspection. Unsafe equipment in use at the time of the inspection included a pendant drop lamp used for illumination that was not guarded to protect the bulb from breakage during use.
