OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by traffic hazards.    On or about 4/25/2012, at the intersection of Church and Third Streets, Keyport, NJ, employees of D&D Trenchless Solutions were preparing to perform sewer vault maintenance within the confines of a public roadway.     a)  Employees were not wearing high visibility garments.      b)  No advance warning signs were posted to warn motorists of the work activity in the roadway.    c)  There was inadequate physical channelization/direction of traffic around the work area.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
