Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fall, struck-by and crushed-by: On or about April 25, 2013, an employee was exposed to the hazards of falling out of and being struck-by a power industrial truck while the employee operated the Genie Forklift, model GTH-1056, s/n: 52777-97, without using the seatbelt while moving construction material around the job site.
