Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a JLG G6-424 forklift equipped with roll over protection (ROPS) overturning or from the operator falling out of the forklift, due to the fact that the operator restraint systems (seat belt) provided on the forklift were not used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to require and effectively enforce the use of the operator restraint systems provided by the manufacturer of the forklift.     a) South end of the worksite: An employee operating the JLG forklift model  G6-424 was observed not wearing the seatbelt provided.
