29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) D.W. Dantas Construction, LLC @ 1015 Wildwood Rd., Avon, CO 81620: On and before 4/24/13, the controlling employer did not maintain a safety program that allowed for frequent and regular worksite inspections with the intent of identifying workplace hazards. A sub-contracted employee was exposed to fall hazards while working on the south fabricated frame scaffold system with incomplete guardrail system. This condition exposed the employee to fall hazard of approximately 12 ft. (b) D.W. Dantas Construction, LLC @ 1015 Wildwood Rd., Avon, CO 81620: On and before 4/24/13, the controlling employer did not maintain a safety program that allowed for frequent and regular worksite inspections with the intent of identifying workplace hazards. A sub-contracted employee was exposed to fall hazards while working on the north fabricated frame scaffold system with incomplete guardrail system. This condition exposed the employee to fall hazard of approximately 25 ft.

Dantas Construction, LLC @ 1015 Wildwood Rd., Avon, CO 81620: On and before 4/24/13, the employer did not ensure than an employee was protected from a fall hazard. An employee off-loaded material from an unguarded porch. This condition exposed the employee to a fall hazard of approximately 12 ft.
