29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:    At the time of the inspection, the employer did not have in place, or implement, a permit required confined space program for employees who enter into aluminum tanker cars to perform welding operations.

29 CFR 1910.146(d)(9):       Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and for preventing unauthorized personnel from attempting a rescue:      At the time of inspection, the employer did not develop and train employees on how to call for rescue services or how to perform a rescue for the emplolyees entering into permit spaces such as aluminum tankers.

29 CFR 1910.252(b)(4)(iv): Where the welder must enter a confined space through a manhole or other small opening, means was not provided for quickly removing the welder in case of emergency. Additionally, an attendant with a preplanned rescue procedure was not stationed outside a confined space opening to observe the welder at all times in case of emergency.    a) At the time of inspection employees were performing MIG welding operations on aluminum inside of tanker trailers in bay 25. The welders inside the confined space were not attatched to a lifeline, nor was an attendant on hand to observe the activity.    b) At the time of inspection employees were performing MIG welding operations on aluminum inside of tanker trailers in bay 22. The welders inside the confined space were not attatched to a lifeline, nor was an attendant on hand to observe the activity.     In the alternative, 29 CFR 1910.146(d)(4)(viii):       Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not provide, at no cost to the employees, rescue and emergency equipment needed to comply with 29 CFR 1910.146(d)(9):      At the time of inspection, the employer did not provide rescue and emergency equipment including but not limited to lifelines, wristlets, and full body harnesses for employees performing welding operations in the permit required confined spaces.

29 CFR 1910.252(b)(2)(iii): Workers and other persons adjacent to the welding area were not required to wear appropriate goggles, to protect them from the rays when noncombustible or flameproof screens or shields were not used:    At the time of inspection, in the service area near bay 22, the employer did not provide welding screens to protect employees walking through the aisle from employees working on a trailer, as welders, from arc flash.    NOTE:    Mac Trailer Manufacturing Company was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 63080, citation number 2 item number 1 and was affirmed as a final order on 09/06/2011, with respect to a workplace located at 14599 Commerce Street Alliance, OH 44601.
