29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. A. American Quality Stripping, Inc., located at 1750 5th Street, Sandusky, OH 44870: On or about April 25, 2013, the employer did not ensure that daily examinations of the powered industrial vehicle Caterpillar (Model E5000, S/N A4EC220520) were conducted before being put into service. The forklifts strobe light was not working, limiting employees awareness of the powered industrial vehicle and exposing them to struck-by and caught-in-between hazards. B. American Quality Stripping, Inc., located at 1750 5th Street, Sandusky, OH 44870: On or about April 25, 2013, the employer did not ensure that daily examinations of the powered industrial vehicle Caterpillar (Model EC30KL, S/N A3EC440218) were conducted before being put into service. The forklifts strobe light was not working, limiting employees awareness of the powered industrial vehicle and exposing them to struck-by and caught-in-between hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
