29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. a) Front of the structure above the main entry: On or about April 24, 2013, and at times prior thereto, an employee utilizing a pneumatic nailer to fasten shingles was not wearing eye protection/safety glasses. b) Front of the structure above the main entry: On or about April 24, 2013, and at times prior thereto, an employee was exposed to overhead hazards while working below an employee involved in roofing activities utilizing small hand tools. Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Front side of residential structure: On April 24, 2013, employees performed roofing activities on a 6 in 12 pitched roof and were exposed to a 13 foot fall hazard to the ground below. Note) Abatement certification IS required for this item.
