29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) The employer does not ensure the use of fall protection during framing work. The violation was most recently observed on April 23, 2013, at 770 North Tullishire Way, Eagle, Idaho, where two employees were setting trusses while standing on the top plate at a height of approximately 11 feet without being protected against fall hazards. Note: To correct this condition, and to continue to comply with the occupational safety and health standard, the employer must ensure that an appropriate fall protection system is available, in place, and used correctly by all employees whose work activity exposes them to a fall hazard of six feet or more to a lower level at this jobsite and at all of employers jobsites. Note: Pursuant to 29 CFR 1903.19, the employer MUST provide documentation that the violation described above in paragraph a) has been corrected within 15 workdays of the date this citation was received. The employer has a continuing obligation to comply with 29 CFR 1926.501(b)(13), the OSH Act, and all relevant occupational safety and health standards. Pro Builders was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), or its equivalent standard, which was contained in OSHA inspection number 308344985, Citation 1, Item 1, and was affirmed as a final order on March 6, 2006, with respect to a workplace located at 2291 N. Villa Highlands, Boise, ID 83702. Pro Builders was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), or its equivalent standard, which was contained in OSHA Inspection number 309969442, Citation 2, Item 3a, and was affirmed as a final order on November 2, 2007, with respect to a workplace located at 442 and 480 E. Laguna, Eagle, ID 83616.
