OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards.  On or about April 26, 2013 and at times prior thereto, the employer did not ensure that all equipment used to aid in the process of rigging up and moving material was rated, labeled and/or inspected throughout the manufacturing facility.    Employees were exposed to struck by and crushed by hazards from the following:  a) In the G5 anodize line area, two 40 feet wide spreader bars were not rated or labeled and four Coffing 1/2 ton hoist pendent control boxes were not clearly marked to identify the functions;  b) In the G5 new line staging room, two 40 feet wide spreader bars were not rated or labeled and four Coffing 1/2 ton hoist pendent control boxes were not clearly marked to identify the functions;  c) In building 7, three spreader bars were not rated or labeled and six Coffing 1/2 ton hoist pendent control boxes were not clearly marked to identify the functions.

The employer did not ensure that the blade guards were adjusted to the height of the material being cut and employees were exposed to struck-by and amputation hazards:  a) Jet Equipment and Tools model # VBS-1610, serial # 7031891; and b) Jet Tools 14" wood/metal vertical band saw, model # J-8201K, serial #12102098

29 CFR 1910.212(a)(5): Fan blade guard(s) were not provided where the periphery of the blades was less than seven feet from the floor or working level:  On or about April 26, 2013, in building one, employees working in the tooling shop operated a 48 inch metal fan that was not guarded on the top and back of the fan.  Employees were exposed to the hazard of being struck by the metal fan blades.

29 CFR 1910.304(g)(5): The paths to ground from circuits, equipment, and enclosures were not permanent, continuous, and effective.  On or about April 26, 2013 and at times prior thereto, the employer did not inspect and ensure that electrical equipment and components were used with a permanent and continuous ground.  Employees were exposed to electrical shock hazards for the following:  a) In building six, employees used a portable 36 inch floor fan that did not have a cord grounding prong. The grounding prong was broken off and missing; and    b) In building eight, employees used a Big Country round floor fan, Model # BCD-42-BDF that did not have a cord grounding pin.  The grounding pin was broken off and missing.

On or about April 26, 2013 and at times prior thereto, the employer did not ensure that unused openings were effectively closed to prevent employee exposure to electrocution and electrical shock hazards:    a) In the anodizing area, two light switch gang boxes had open holes on the top with visible conductors; and    b) In building six, the Murdock, Inc. hot forming press control cabinets and boxes operating at 3 phase 480 volts, had four large openings with live visible conductors and circuits.
