OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed struck-by hazards during aerial lift operations: a. On or about 4/23/13, West Tower of Standard Elevator 2, the employer did not insure that an aerial lift was adequately inspected prior to use and did not restrict use when wind speeds exceeded those recommended by the manufacturer which exposes employees who operate the aerial lift to struck-by hazards.
