The employer did not ensure he was working outside the zone of danger or provide another method of protection for the hatch boss exposed to the dangers of crushing hazards while working beneath suspended containers.

29 CFR 1918.85(l): When an employee was working along an unguarded edge where a fall hazard existed, the employer did not provide fall protection meeting the requirements of 29 CFR 1918.85(k). Onboard M/V COSCO ANTWERP, bay thirty: A hatch boss was exposed to a fall of eight feet ten inches when he was standing directly over a twenty seven by twenty inch access opening on the upper level catwalk and was not protected by a fall protection system meeting the requirements of 29 CFR 1918.85(k)

OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that a hatch boss was exposed to crushing injuries from being struck-by intermodal containers. Onboard M/V COSCO ANTWERP, bay thirty, forward, upper level and aft catwalk: The employer does not require employees to keep clear of work in the zone of danger and/or stay out of the bight or provide an alternative method of protection for employees while they working near suspended containers. Employees are at risk of being struck-by an intermodal container if it swings or falls when they're working in the vicinity of the container, including situations in which a twist lock becomes inoperable. This was most recently observed on April 22, 2013 when: a) while unlocking and waiting to unlock inoperable twistlocks on bay thirty, forward, upper level catwalk, a crane boss was exposed to being struck-by intermodal containers when working in the aisle adjacent to a container bay being discharged and within thirty six inches of the area where containers were being handled by the crane and; b) while unlocking and waiting to unlock inoperable twistlocks on bay thirty, aft catwalk, a crane boss was exposed to being struck by an intermodal container or its contents when working in the aisle adjacent to a container bay being discharged and within one container width of container being handled by the crane. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: To follow OSHAFact Sheet (FS-3583 dated 12/2012) titled "Freeing Inoperable Semi-Automatic Twist Locks (SATLs) in Longshoring", the recommendations of the Maritime Advisory Committee for Occupational Safety and Health (MACOSH) longshore group and the Pacific Coast Marine Safety Code Rule #1513. SSA Marine was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard Section 5(a)(1) which was contained in OSHA Inspection #312422264, Citation #001, Item 001, issued on 02/17/2009 having a Final Order March 3, 2011.
