OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed struck-by hazards during aerial lift operations:    On or about 4/23/13, Standard Elevator 2, the employer rented an aerial lift to a subcontractor who operated the aerial lift when wind speeds exceeded 28 mph for grain tower construction, and the employer did not ensure the following was completed for the aerial lift thereby exposing employees to struck-by hazards:     1.     Adequate inspection and repair prior to delivery;  2.     Development of written inspection and maintenance records; and  3.     Review aerial lift control functions and specific safety devices with a lessee at delivery.

29 CFR 1926.1416(d)(3)(i): Telescopic boom cranes manufactured after February 28, 1992, were not equipped with a device which automatically prevents damage from contact between the load block, overhaul ball, or similar component, and the boom tip (or fixed upper block or similar component):    a.  On or about 4/23/13, North Bin of Standard Elevator 2, an anti-two-blocking device was not equipped on a telescopic boom crane used to lift a catwalk thereby exposing employees to struck-by hazards.
