29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: a) On or about April 22, 2013 at the Walgreens construction site, 3140 Highway 280, Alexander City, Al.: The employer failed to ensure an employee working from the basket of a Genie S-45 aerial lift wore fall protection which exposed him to the hazards of falls up to 24 feet 7 inches to the ground below.

29 CFR 1926.454(b): The employer did not have each employee who was involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work: a) On or about April 22, 2013 at the Walgreens construction site, 3140 Highway 280, Alexander City, Al.: The employer failed to ensure an employee was trained to operate a Genie S-45 aerial lift in tight areas requiring precise movement which resulted with the employee getting caught between the aerial lift control panel plate and an awning steel tube resulting in death.
