29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Trench: On or about April 24, 2013, the employer did not ensure its designated competent person on-site conducted an effective inspection and evaluation of the potential hazards and determine the necessary precautions to protect employees working inside the trench exposing employees to cave-in and other trench related hazards.
