29 CFR 1926.201(a) Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers, did not conform to Part VI of the Manual of Uniform Traffic Control Devices 1988 Edition; Revision 3 or the Millennium Edition.    (a)    On, or at dates prior to, April 26, 2013, workers were exposed to struck-by hazards by oncoming traffic as they performed traffic control as flaggers without wearing safety vests.         Or, in the alternative, Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being stuck-by motor vehicles.      (a)    Workers were performing traffic control within the right-of-way of a city street without wearing safety vests.        One feasible and acceptable method to correct the hazard is to follow the requirements of the Manual of Uniform Traffic Control Devices, 2009 Edition,  Section 6D.03.04 which states, "All workers, including emergency responders, within the right-of-way who are exposed either to traffic, (vehicles using the highway for purposes of travel) or to work vehicles and construction equipment within the traffic control zone shall wear high-visibility safety apparel that meets the Performance Class 2 or 3 requirements of ANSI/ISEA 107-2004. 29 CFR 1926.854(b)  A wall section, which was more than one story in height, was permitted to stand alone without lateral bracing, and the wall section was not designed or constructed to stand alone without lateral support.     (a) On April 26, 2013, at 801 Mulberry St, Kansas City, Missouri, employees were exposed to a struck-by hazards because the east side exterior wall remained standing approximately three stories in height prior to being demolished by mechanical means by the use of a bucket attachment of an excavator.  The wall section did not have any lateral bracing and was not constructed to stand alone.       Abatement Note: Abatement certification is not required for this item.

29 CFR 1926.859(g) During demolition, continuing inspections by a competent person were not made as the work progressed to detect hazards resulting from weakened or deteriorating floors, or walls, or loosened material.  Employees were permitted to work where such hazards existed before they were corrected by shoring, bracing, or other effective means.   (a)    On April 26, 2013, while mechanically demolishing a free-standing masonry wall, the employer failed to perform continuing inspections to detect struck-by hazards posed to employees from weakened and loosened material, and the employer permitted employees to work where such hazards existed without correcting the hazards by ensuring employees were removed from the area.
