OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being {�} which are causing or likely to cause death or serious physical harm to employees: This violation was observed on or about May 7, 2013 and at times prior thereto, in the Rack-up area where employees were exposed to being struck-by and crushed-by loads lifted with Finger Bow Baskets that had hazardous conditions that were not repaired before normal operations of the lifter had been resumed. Pursuant to 29 C.F.R.1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to make adjustments and repairs to correct any hazardous conditions on the Finger Bow Baskets before normal operations of the lifters are resumed.

29 CFR 1910.23(a)(5): Every pit and floor opening was not adequately guarded by standard railing or any other effected means. The employer does not cover every floor hole into which persons can accidentally walk. This violation was observed on or about April 29, 2013, at the zinc kettle where employees were exposed to a fall hazard when walking around unguarded floor openings that serve as heat ventilation. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling into unguarded floor openings.
