OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On or about April 30, 2013, and at times prior, employees were potentially exposed to crushing and struck-by hazards while operating automotive lifts under the following conditions: 1) The employer had not trained employees on the safe use and operation of the lifts using the manufacturer's provided instructions; 2) Auto lifts were not periodically inspected by qualified inspectors at least annually to ensure that they were properly maintained and functioning; 3) On all of the Challenger lifts, safety warning labels and the rated load capacity of the lifts were not legible. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch: a) On or about April 30, 2013, and at times prior, employees were exposed to injury where the tongue guard on the American Forge pedestal grinder was out of adjustment in excess of 1/4 inch.
