Designs of support systems, shield systems, and other protective systems shall be selected and constructed by the employer or his designee and designs for timber shoring in trenches shall be determined in accordance with the conditions and requirements set forth in appendices A and C to this subpart. WORKSITE: The "Timber Shoring" used as cave-in protection for the employee working in the trench was not selected and determined in accordance with conditions and requirements set forth in appendices A and C.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: WORKSITE: The employee working in a trench measuring 25 feet long, and between 5 and 6 feet deep with nearly vertical walls was not adequately protected from trench wall cave-ins. Mondo Construction Company LLC was previously cited for a violation of this occupational safety and health standard (29 CFR1926.652(a)(1)), which was contained in OSHA inspection number 314399346, citation number 1, item number 3, affirmed as a final order on 7/28/2010, with respect to a workplace located at Pine and Middle Street , Bristol, Ct 06010.
