29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck was dismounted and within 25 ft. of the truck still in his view, the load engaging means were not fully lowered, controls neutralized, and the brakes set to prevent movement:                                                                                        This violation was occurred on or about May 1, 2013 and at times prior thereto, in the agglomerator room, employees dumping material from a 300 lb. drum into the hopper were required to dismount from the forklift and standing next to the mast with the forklift tines raised, pull the chain attached to the drum holder to tilt the drum exposing the employees to being struck by hazards.
