Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:       Employees performing railcar inspections and working on the top of the railcar are exposed to falling from the fixed ladder in that employees do not use both hands for climbing. The employer failed to implement alternate methods for employees to handle tools, materials and supplies while ascending and descending ladders.       Among other methods, one feasible and acceptable means of abatement would be to follow the American National Standards Institute for Ladders  Fixed  Safety Requirements (ANSI ASC A14.3 - 2008), Section 9.2.1 which requires users to maintain three points of contact and Section 9.2.2 which requires both hands and arms to remain free for climbing.

29 CFR 1910.23(c)(1):  Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:     Employees performing product measuring and loading were exposed to fall and struck-by hazards and the employer did not ensure open-sided floors and platforms four feet or more above adjacent floor or ground level were not guarded with standard railings and toeboards.    A) Employees working in the tank farm are exposed to struck-by hazards and the employer did not ensure toeboards were provided along the runway between the tanks in the tank farm.    B) Employees performing product loading at the truck loading dock were exposed to a fall of approximately 18.5 feet.  A gap in the guard railing provided inadequate protection while on the platform runway and fall protection was not provided while employees were on top trailers performing product loading.

29 CFR 1910.23(e)(1):  Standard railing(s) did not consist of top rail, intermediate rail and/or posts and/or did not have a vertical height of 42 inches (106.7 cm) nominal from upper surface of top rail to floor, platform runway, or ramp level:     On or about May 1, 2013 employees were exposed to fall hazards from improperly guarded platforms and runways and the employer did not ensure railing was installed at 42 inches from the floor or platform runway.       A) Employees performing product level measurements in the tank farm were exposed to falls of 40 feet.  Platforms at the tank access were not provided with guard railing at the correct height.       B) Employees performing product blending are exposed to falling 10 feet to the ground from the stairway platforms in that the detachable wire rope top rail was broken and not maintained at 42 inches from the platform.       C) Employees performing product loading on the truck dock were exposed to falling 18.5 feet and the employer did not ensure intermediate rails were approximately halfway between the top rail and the platform.
