OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazard of being thrown from the operator's seat while operating an industrial truck without seatbelts. A) Workplace, on or about May 2, 2013, employees operated a Hyster industrial truck forklift, that did not have a seatbelt, exposing employees to a hazard of being thrown out of the cap of the forklift.
