29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: A. E.R. Zeiler Excavating, Inc. worksite located near 5846 Detroit Ave., Toledo, Ohio: On or about April 25, 2013, the employer failed to ensure a safe means of egress such as a ladder was provided to employees installing a 15 inch sanitary sewer line in a trench approximately 6.80 feet deep. Employees were using the south end of the box by climbing up the backfill to exit the trench. E.R. Zeiler Excavating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651, which was contained in OSHA inspection number 313780280, citation number 2, item number 1 and was affirmed as a final order on December 12, 2009, with respect to a workplace located at Toledo.
