29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) Jobsite, 407 West Horner Street, Ebensburg, PA:  On or about May 2, 2013, an employee was working on a residential roof without utilizing any method of fall protection.  The employee was removing old and installing new shingles at approximately 28 feet above the ground below.  The pitch of the roof was 6 in 12.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Jobiste, 407 West Horner Street, Ebensburg, PA:  On or about May 2, 2013, an employee was working on a residential roof at heights of 28 feet above the ground below, without fall protection and had been not provided any fall protection training to recognize the hazards of working at heights and how to reduce/eliminate them.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) Jobsite, 407 West Horner Street, Ebensburg, PA:  On or about May 2, 2013, employees were using a 32 foot Werner extension ladder to gain access to the roof and it was only extended about 12 inches above the upper landing surface.
