29 CFR 1903.19(d)(1): The employer did not submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:  a)    The employer Apply Rite Roofing, LLC failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1 for hazards associated with; 1-1)  roofers installing a new rubber roof had not received training and education on the proper fall protection methods to use when exposed to falls, open unprotected floor holes and the use of ladders; 1-2)  roofers installing a new rubber roof were exposed to a 10 foot fall hazard due to an access hold not having a cover or other means of protection; 1-3) roofers working all the edge of a flat residential roof structure without conventional fall protection were exposed to a 20' fall hazard; and 1-4)  roofers were exposed to a 7' 1/2" fall hazard when standing on the top step of a stepladder to gain access to the roof.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) Roofers installing a new rubber roof on an apartment building had not received training and education on the proper fall protection methods to be used when exposed to perimeter falls, open unprotected floor hole(s) and ladder use.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  a) Roofers installing a new rubber roof on an apartment building were exposed to a 10 foot fall hazard due to the access hole to the roof measuring 26 and one-half inches X 39 inches having no cover or other means of protection.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Located along all edges of the flat residential roof structure, roofers were observed performing roofing associated operations without conventional fall protection and were exposed to fall potentials of 20 feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step.  a) Roofers were exposed to an 7' one-half foot fall hazard due to the use of the top step of the stepladder when using it to gain access to the roof.
