29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level: a) construction site of new apartment building at 4756 Spring View Dr. in Erie, PA. On or about May 3, 2013, employees were not protected from falling 23 feet to the ground while performing masonry work from the Non-Stop Scaffolding system. Fall protetion systems such as guardrail systems and/or personnel fall arrest systems were not utilized as a means of protection.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section: a) construction site of new apartment building at 4756 Spring View Dr. in Erie, PA. On or about May 3, 2013, employees were not protected from falling objects such as, but not limited to bricks, masonry tools and equipment when working on the ground, below the Non-Stop Scaffolding system. Falling object protection was not utilized on and/or around the scaffold.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees a) construction site of new apartment building at 4756 Spring View Dr. in Erie, PA: On or about May 3, 2013, personnel were potentially exposed to struck-by and caught-between hazards from a Rough Terrain Forklift that was unoccupied/unattended while its boom/forks were elevated. The Gehl Rough Terrain Forklifts forks were elevated at least 23-feet above the ground and were positioned at/near the Non-Stop Scaffolding systems work platform. While the boom and forks were elevated, all personnel were at least 23-feet above the ground on the scaffold and no one was in the Gehl Rough Terrain Forklifts cab and/or its operating controls.
