OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees    a) construction site of new apartment building at 4756 Spring View Dr. in Erie, PA:  On or about May 3, 2013, personnel were potentially exposed to struck-by and caught-between hazards from a Rough Terrain Forklift that was unoccupied/unattended while its boom/forks were elevated. The Gehl Rough Terrain Forklifts forks were elevated at least 23-feet above the ground and were positioned at/near the Non-Stop Scaffolding systems work platform.  While the boom and forks were elevated, all personnel were at least 23-feet above the ground on the scaffold and no one was in the Gehl Rough Terrain Forklifts cab and/or its operating controls.
