Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevated platform: A.) Charles Young & Sons Masonry, LLC, 821 West Erie Plaza, Erie, PA 15605, rear of the structure, on or about October 10, 2013 and times prior thereto: An employee was utilizing a pallet that was supported by the forks of a rough terrain forklift truck to clean bricks with masonry cleaner and a pressure washer. The employee was observed working at a height of 7.5 feet above ground level. The employee was not utilizing a means or method of fall protection. B.) Charles Young & Sons Masonry, LLC, 821 West Erie Plaza, Erie, PA 15605, rear of the structure, on or about October 10, 2013 and times prior thereto: An employee was utilizing a pallet that was supported by the forks of a rough terrain forklift truck to clean bricks with masonry cleaner and a pressure washer. The employee was observed working at a height of 7.5 feet above ground level. The pallet was not secured to the mast of the forklift truck.

Charles Young & Sons Masonry, LLC, 821 West Erie Plaza, Erie, PA 15605, rear of the structure, on or about October 10, 2013 and times prior thereto: An employee was operating a Gehl 553 rough terrain forklift truck. The employee operating the forklift truck raised a second employee to a height of 7.5 feet via the forks and a pallet in which the employee was standing on. The employee operating the forklift was not trained on approved attachments for manlift operations, and methods for properly securing attachments to the mast of the forklift.
