29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    (a)  At ABC Powder Coating:  The employer did not perform an evaluation of the possible air contaminants such as but no limited to silica, total dust and paint vapors to determine the type of respiratory protection and other personal protective equipment necessary to perform the sandblasting and paint coating work safely.         (1)  On or about July 10, 2013, an employee doing sandblasting was exposed to an 8 hour time weighted average (TWA) level of 15.70 mg/m3 of total dust, which is 1.05 times the OSHA permissible exposure level (PEL) of 15 mg/m3.

29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:    (a)  At ABC Powder Coating Company:      (1) The employer did not develop and implement a written respiratory protection program.  Employees were wearing supplied air and half face respirators.    (2)  On or about July 10, 2013, an employee doing sandblasting was exposed to an 8 hour time weighted average (TWA) level of 15.70 mg/m3 of total dust, which is 1.05 times the OSHA permissible exposure level (PEL) of 15 mg/m3.    (3) Employees were potentially exposed to silica, total dust and respirable dust when performing sandblasting.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a)  AT ABC Powder Coating Company:  The employer did not develop and implement a  written hazard communicaition program.  Employees are exposed to silica, total dust and paint vapors when they are sandblasting and painting.    (1)  On or about July 10, 2013, an employee doing sandblasting was exposed to an 8 hour time weighted average (TWA) level of 15.70 mg/m3 of total dust, which is 1.05 times the OSHA permissible exposure level (PEL) of 15 mg/m3.
