29 CFR 1910.1030(d)(2)(vii)(A): Contaminated needles and other contaminated sharps were bent, recapped, or removed: a) At the Clinic, lancets without a built-in safety feature or a safety mechanism, and designed for self-testing, were used by employees to perform blood glucose tests and were manually removed from the holding device, exposing employees to needle stick injuries.

29 CFR 1910.1030(f)(1)(ii)(D): The employer did not ensure that all medical evaluations or procedures including the hepatitis B vaccine, vaccination series, post-exposure evaluation, or follow-up, including prophylaxis, were provided according to recommendations of the US. Public Health Service current at the time these evaluations and procedure took place: a) Rapid HIV testing of source patients, to facilitate making timely decisions regarding use of HIV post exposure prophylaxis (PEP) after occupational exposures to sources of unknown HIV status, was not available in accordance to the September 30, 2005 U.S. Public Health Service Guidelines for the Management of Occupational Exposures to HIV, and Recommendations for Postexposure Prophylaxis.
