29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift:     a) Jobsite, One Waterfront Place: On or about April 30, 2013, during construction activities, the employer did not ensure that an employee in the bucket of an aerial lift was using fall protection systems/devices, where exposed to a fall hazard of approximately 20 feet.   Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.416(a)(1): The employer permitted an employee to work in such proximity to any part of an electric power circuit that the employee could have contacted the electric power circuit in the course of work, and the employee was not protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means:      a) Jobsite, One Waterfront Place: On or about April 30, 2013, during construction activities, the employer did not ensure that an employee moving a temporary power line was protected against accidental shock in that the power going to the line was not controlled prior to the start of work.
