29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employees noise exposures equalled or exceeded an 8 hour Time Weighted Average (TWA) sound level of 85 dBA: (a) Warehouse - The employer had not instituted a hearing conservation program to include a fabricator exposed to a projected TWA of 87.9 while performing polishing and sanding of a stone countertop, on or about 5/6/2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (a) Warehouse - Fabricators wore 3M Tekk Model 8110S N95 respirators to protect against their being exposed to dust while conducting stone countertop polishing and sanding operations in the Polishing Room. Appendix D information was not reviewed with and provided to the laborers permitted to use respirators, on or about May 6, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
