29 CFR 1910.1020(d)(1)(ii): Each employee exposure record was not preserved and maintained for at least thirty (30) years: (a) On or about 05/06/2013, at establishment, for employees working in the yogurt filling machine room who were exposed to hydrogen peroxide vapor from the filling operations. Maintenance department had been obtaining hydrogen peroxide exposure readings while trouble shooting employee health complaints but did not maintain exposure records.

29 CFR 1910.1020(e)(3)(i): The employer did not ensure, upon request, and without derogation of any rights under the Constitution or the Occupational Safety and Health Act of 1970 that the employer chose to exercise, the prompt access of representatives to employee exposure and medical records and/or to analyses using exposure or medical records: (a) On or about 05/06/2013, at establishment, for employees working in the yogurt filling machine room who are exposed intermittently to hydrogen peroxide vapors from the yogurt cup sterilization process. Maintenance personnel had periodically recorded hydrogen peroxide levels upon employee complaint of illness but records were not maintained and not provided during inspection.
