29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or equivalent) on all open sides: a) Downtown Erie Hotel, 18 W. 18th St., Erie, PA. On or about May 6, 2013, and times prior thereto, employees were potentially exposed to a fall hazard of four (4) stories above the ground while on the flat roof of the hotel. Employees were power-washing the roof in preparation to repaint it. Employees were not protected from falling by guardrails and/or equivalent protection. OR IN THE ALTERNATIVE: 29 CFR 1910.132(a): Protective equipment was not used wherever it is necessary by reason of hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body: a) Downtown Erie Hotel, 18 W. 18th St., Erie, PA. On or about May 6, 2013, and times prior thereto, employees were potentially exposed to a fall hazard of four (4) stories above the ground while on the flat roof of the hotel. Employees were power-washing the roof in preparation to repaint it. Employees were not utilizing personal fall arrest systems (PFAS) while performing the activities related to preparing the roof to be repainted.

29 CFR 1910.26(c)(3)(vii): Ladders were used for other uses than that for which they were intended, unless specifically recommended for use by the manufacturer: a) Downtown Erie Hotel, 18 W. 18th St., Erie, PA. On or about May 6, 2013, and times prior thereto, employees were potentially exposed to a fall hazard of at least six feet (6') while using a stepladder to access the roof of the hotel. Employees used a Warner, 6-foot stepladder to climb up to and down from the roof. The stepladder was not used for its intended purpose in that personnel utilized the top step and the ladder was too short to reach the access opening.
