OSH ACT of 1970 Section (5)(a)(1): Employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from an overhead electric powered hoist which was not equipped with identification stating the hoist's size, grade, lifting capacity and reach, or a hook with a latch to bridge the throat opening of the hook and retain items:      West end of welding shop: On or about May 6, 2013, an employee spray painting a large, 100-150 pound metal gate, which was hanging and swinging at a height of approximately 7 feet, was exposed to a struck-by hazard while using an unmarked overhead electric powered hoist that was not equipped with identification stating the hoist's size, grade, lifting capacity and reach, or a hook with a latch to bridge the throat opening of the hook to lift and hold the metal gate.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:    On or about May 6, 2013, employees were exposed to explosion, struck-by and high pressure system hazards from:     (a) Gas cylinder loading and storage area, West side of main building: Various unsecured, compressed gas cylinders which were stored in a high traffic, outdoor area and were not protected against tampering by unauthorized individuals.    (b) Gas cylinder loading and storage area, West side of main building: Empty compressed gas cylinders which were not delineated as "EMPTY".    (c) Gas cylinder loading and storage area, West side of main building: Unsecured, full 92% Argon/ 8% Carbon Dioxide Mixture compressed gas cylinders which were stored in a high traffic, outdoor area and were not protected against tampering from unauthorized individuals.    (d) Gas cylinder loading and storage area, West side of main building: Various compressed gas cylinders which were stored outdoors and were not protected from the ground underneath to prevent rusting.    (e) Gas cylinder loading and storage area, West side of main building: Compressed gas cylinders containing flammable and oxidizing gases stored together .    (f) Outside storage cage, Northside of welding shop: Unsecured, full Oxygen compressed gas cylinders, which were both stored and in use, and were not  protected against tampering by unauthorized individuals.    (g) Welding shop, near north and east entrance: Full and empty 92% Argon/ 8% Carbon Dioxide Mixture compressed gas cylinders which were unsecured.
