29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: For the Flagstone Pavers facility at 9070 Old Cobb Rd., Brooksville, FL 34601, as observed on or about 05/07/2013, Maintenance employees performed maintenance on equipment at the facility on a routine basis, and specific lockout tagout procedures had not been developed for equipment on which maintenance was performed. Machinery such as, but not limited to, the following was at the facility and was serviced by maintenance staff: a) Zeneth 860 Brick Paving Machine 240/480V, hydraulic energy, mechanical energy/gravity potential energy b) Zeneth Palletizing/conveying equipment 240/480V, hydraulic energy c) Zeneth Finger Transfer Car 240/480V electricity, hydraulic energy d) Mixers 240/480V, hydraulic, mechanical energy e) All other aggregate, mixture, and final product conveying machines 240/480V electricity, hydraulic energy, pneumatic energy

The gap was present due to a missing breaker in the panel whose slot had not been covered to guard against live part contact.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) For the Flagstone Pavers facility at 9070 Old Cobb Rd., Brooksville, FL 34601, as observed on or about 05/07/2013, employees used, as needed, a man basket with forklifts to reach elevated heights. Written approval for safe use of the man basket with the forklift had not been obtained from the forklift manufacturer.
