29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a)  1214 N 4th Street, Philadelphia, PA-  Subcontractor employees engaged in installing a fiberglass roofing system on the front roof of a new residential structure were exposed to fall hazards of approximately 32 feet to the sidewalk below without any form of fall protection.  Observed on or about May 6, 2013.     b)  1214 N 4th Street, Philadelphia, PA- An employee inspecting and overseeing the roofing subcontractor's work from the adjacent roof of the next row house was exposed to fall hazards of approximately 28 feet to the sidewalk below without any form of fall protection.  Observed on or about May 6, 2013.     NOTE:  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:     a)  1214 N 4th Street, Philadelphia, PA- An employee worked on a roof overseeing and inspecting a subcontractor's work where he was exposed to fall hazards of approximately 28 feet to the sidewalk below without training in the procedures to be followed to minimize the hazard.  Observed on or about May 6, 2013.    NOTE:  Abatement certification and documentation required within 10 days after abatement date.
