29 CFR 1910.26(c)(1): Good safe practices in the use and care of ladder equipment were not employed by the users to get maximum serviceability, safety, and to eliminate unnecessary damage of equipment:    (a) Back of Store - Employees used a Werner 6-foot aluminum step ladder to access the storage area above the office.  The storage area had a height above the floor of 8 feet 7.5 inches, so employees used the top step and top cap of the ladder in order to get onto and off of the storage area, exposing employees to a hazard of falling to the floor below, on or about April 21, 2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state that employees and their representatives were informed of this abatement.

The storage area had a height above the floor of 8 feet 7.5 inches and had two open sides (i.e., sides without a standard railing), one side 7 feet 4 inches long and the other 5 feet long.  While working on the storage area to retrieve or stow items, employees did not use personal fall arrest or restraint equipment to protect them from falling from the two open sides to the floor below, on or about April 21, 2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state that employees and their representatives were informed of this abatement.
