OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling debris and a structural failure: a) Un-nailer wooden structure: On May 2, 2013 and at times prior thereto employees were exposed to the hazard of being struck-by scrap wood, sheets of metal, and other debris stored above the work area. Employees were exposed to the potential hazard of being crushed-by the sides and cover of the unstable structure in the event of a collapse. Note) Abatement certification IS required for this item.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition: a) Un-nailer work area: On May 2, 2013 and at times prior thereto employees using the un-nailer machine were exposed to struck-by and tripping hazards. Scrap wood, materials, equipment, and other miscellaneous debris was stored and allowed to accumulate in, around and on top of the wood structure where the machine was located. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, and flying chips: a) Work area: On May 2, 2013 and at times prior thereto large portions of the blade guard and kerf plate on the DeWalt miter saw were broken off and missing. This exposed the employee to an unguarded point of operation amputation hazard when using the tool. Note) Abatement certification IS required for this item.
