29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. On or about May 8, 2013, at the above addressed jobsite, an employee was engaged in the installation of air conditioning duct work on a second floor at approximately 10 feet 6 inches above ground level from a step ladder that was positioned approximately 3 feet from a staircase opening with no guardrails, exposing him to a fall hazard. NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT MUST BE SUBMITTED FOR THIS ITEM.
