29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer: a) Light Logic, LLC dba Framburg, Bellwood, IL, did not develop and implement a written respiratory protection program, to include the following provisions, as applicable, for employees in the Plating and Polishing department(s): The program must be administered by a suitably trained program administrator as well as include: (i) Established standard operating procedures for selection and use of respirators in the workplace; (ii) Medical evaluations of employees required to use respirators; (iii) Fit testing procedures for tight-fitting respirators; (iv) Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; (v) Procedures and schedules for inspecting, discarding or otherwise maintaining respirators; (vi) Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations; (vii) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and (viii) Procedures for regularly evaluating the effectiveness of the program. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

The employer did not develop and implement at the workplace a written hazard communication program which describes how the following program elements must be met: 1) Labeling requirements for the containers/packages of the hazardous chemicals, including in-house secondary containers; 2) Maintenance and availability of material safety data sheets; 3) Employee training; 4) A complete and accurate master list or inventory of the hazardous chemicals known to be in the workplace; 5) Methods to inform employees of the hazards of non-routine tasks, and 6) Methods to inform other employers/contractors of material safety data sheet availability, labeling system and any other precautionary measures to protect employees. The hazard communication training must include how the following elements specified in 29 CFR 1910.1200 must be met: 1) The requirements of the Hazard Communication Standard; 2) The hazardous chemicals in their work area, and the operations in the work area where hazardous chemicals are present; 3) The physical (i.e., flammable, combustible, oxidizing, reactive, etc.) and health hazards of the chemicals in the work area, and the measures employees can use to protect themselves, such as work practices, housekeeping, personal protective equipment (PPE) to be used, and emergency procedures; 4) The methods and observations used to detect the presence or release of a hazardous chemical in the work area; 5) The labeling system and the Material Safety Data Sheets (MSDSs), and how the workers can obtain and use the appropriate hazard information; 6) The location and availability of the Material Safety Data Sheets (MSDSs).
