29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On or about May 5, 2013 on the construction site located at 1001 West Rochier in Fayetteville, Arkansas, employees were exposed to slip and fall hazards egressing in and out of a trench greater than five feet deep. The excavation did not have a ladder, ramp or other safe means for entering or exiting.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems. On or about May 5, 2013 and times prior thereto the employer failed to have excavations inspected by a competent person prior to having employees enter an excavation greater than five feet deep. On the construction site located at 1001 West Rochier in Fayetteville, Arkansas an employee entered an excavation greater than 6 feet deep without it being inspected by a competent person prior to entry.

On the construction site located at 1001 W. Rochier in Fayetteville, Arkansas an employee was working in a trench that measured over 6 feet deep without a protective system in place or proper benching and sloping to prevent a cave-in.
