29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about May 07, 2013, employees performing construction activities on a 4 story apartment complex were not protected from falling when working near unprotected wall openings on the third and fourth floors. Employees were exposed to the hazard of falling approximately 30 feet to the concrete below.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute (ANSI) B56.1-1969, Safety Standards for Powered Industrial Trucks. On or about May 07, 2013, the employer did not ensure that safe operating procedures or practices were followed when operating the SkyTrak 10054 tele-handler. Employees were exposed to struck by hazards such as the following: a) when the operator was more than 25 feet from the SkyTrack with a suspended load of construction material, and b) when employees were not protected from standing or passing under the suspended load.
