29 CFR 1926.451(b)(3): The front edge of all platforms was not 14 inches (36 cm) or less from the face of the work, and no guardrail systems were erected along the front edge and/or no personal fall arrest systems were used in accordance with paragraph (g) of this section to protect employees from falling: a) North Side of the Building - A subcontracted laborer was observed straddling between a tubular welded frame scaffold and the window sill which were 30 inches apart exposing him to a 51 inch fall on to the porch overhang, on or about 05/06/13. This contractor is the controlling and correcting employer at the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. Therefore, he was aware of the operations in progress. This contractor is being cited Under the Multi-Employer Workplace Policy. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms. a) North Side of the Building - A subcontracted laborer was observed on a tubular welded frame scaffold which was not equipped with an end rail fall protection exposing him to a 19 foot 6 inch fall hazard, on or about 05/06/13. This contractor is the controlling and correcting employer at the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he corrected observed hazards involving the sub-contractor prior to the inspection. Therefore, he was aware of the operations in progress. This contractor is being cited Under the Multi-Employer Workplace Policy. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stair rail system along each unprotected side or edge: b) Throughout the Building - Various foremen and workers were observed using the interior stairs which were not equipped with a standard hand rail exposing them to an 11 foot fall hazard, on or about 05/06/13. This contractor is the controlling and correcting employer at the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he corrected observed hazards involving the sub-contractor prior to the inspection. Therefore, he was aware of the operations in progress. This contractor is being cited Under the Multi-Employer Workplace Policy in addition to having exposed employees to this hazard. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. The Capitol City Real Estate Construction Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 315913731, citation number 1, item number 7 and was affirmed as a final order on 09/17/2012 by ALJ Decision, with respect to a workplace located at1323 Girard St. NW, Washington DC 20010.
