29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  (a) On or about May 7, 2013, at the VA Medical Center, 1030 Jefferson Ave, Memphis, TN, on the 2nd floor Nursing Admin Remodel project, employees were exposed to hazardous materials (Kleen Strip Stripper, Flux, Oatley No5 Lead Free Solder) covered by the Hazard Communication Standard and the employer did not maintain a copy of the written hazard communication program at the worksite.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1)(i): The employer did not comply a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet.  a) On or about May 7, 2013, at the VA Medical Center located at 1030 Jefferson Ave, Memphis, TN, on the Admin Building 2nd Floor Nursing Administration Area Remodel Project, employees were exposed to Klean Strip Stripper, Flux, and Oatey No 5 Lead Free Solder Paste which are covered by the hazard communication standard and were not provided access to a list of hazardous materials known to be present at the site.  Without proper information on hazardous materials, employees could mis-handle hazardous materials and expose themselves to bodily injury and/or disease, allergic reactions, and various irritations both internal and external.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8): The employer did not ensure that Safety Data Sheets (SDS's) were readily accessible during each work shift to employees when they were in their work area(s).  a) On or about May 7, 2013, at the VA Medical Center, 1030 Jefferson Ave, Memphis, TN, on the Admin Building 2nd Floor Nursing Administration Renovation Project, employees were exposed to Klean Strip Striller, Flux, and Oatey No5 Lead Free Solder Paste, (which are covered by the hazard Communication Standard) and did not have access to Safety Data Sheests for these materials.
