29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  (a) On or about May 7, 2013, at the VA Medical Center, 1030 Jefferson Ave, Memphis, TN, on the 3rd floor OR Remodel Project, employees were exposed to hazardous materials (FPPI PipeFit AS Anaerobic Thread Sealant Paste w/ PTFF) covered by the Hazard Communication Standard and the employer did not maintain a copy of the written hazard communication program at the worksite.  Without proper information on hazardous materials, employees could mis-handle hazardous materials and expose themselves to allergic reactions, skin, and respiratory irritations.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet.  a) On or about May 7, 2013, at the VA Medical Center, 1030 Jefferson Ave, Memphis, TN, on the 3rd Floor OR Project, employees were exposed to hazardous materials (FPPI PipeFit AS Anaerobic Thread Sealant Paste w/ PTFF) covered by the hazardous communication standard and did not have access to a list of hazardous materials used on the work site.   Without proper information on hazardous materials, employees could mis-handle hazardous materials and expose themselves to allergic reactions, skin, and respiratory irritations.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8):   The employer did not ensure that Material Safety Data Sheets (MSDS's) were readily accessible during each work shift to employees when they were in their work area(s).  a) On or about May 7, 2013, at the VA Medical Center, 1030 Jefferson Ave, Memphis, TN, 3rd Floor OR Project, employees were exposed to FPPI PipeFit AS Anaerobic Thread Sealant Paste w/ PTFF used to seal fire sprinkler pipe joints and did not have immediate access to the Materiial Safety Data Sheets for this material.  Without proper information on hazardous materials, employees could mis-handle materials and expose themselves to allergic reactions, and various irritations both internal and external.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
